b) A.K. Gopalan V. State of Madras

About Kesavananda Bharati Vs. State of Kerala ( 1973):

The basic structure of the constitution came from the Kesavananda Bharati Case judgment. However, the Basic structure has not been mentioned anywhere in the Constitution. It is put to the Supreme Court to define and include the list in the Basic structure of the Constitution.

In this case, Justice Sikri expressed  "Preamble of our Constitution is of extreme importance and the Constitution should be read and interpreted in the light of the grand and noble vision expressed in the Preamble"


Berubari Union ( 1960):

No constitutional amendment is needed for internal re-adjustment of the boundary of Indian states/Union Territories. However, a constitutional amendment is needed if the land swapping happens with a foreign country.


A.K. Gopalan Vs. State of Madras ( 1950):

A.K. Gopalan Vs. The state of Madras was related to the Preventive Detention Act of 1950, which allowed the government to detain individuals without trial if they posed a threat to national security.


In Kerala Education Bill ( 1957):

The Kerala Education Bill sought to regulate appointments and conditions of teachers.
